Terms of Service

These Terms govern the use of Kasba CRM (the "Service"), a software-as-a-service customer relationship management platform for real estate developers, provided by the operator of Kasba CRM ("we", "us"). By creating an account or using the Service, the company you represent ("Customer", "you") agrees to these Terms.

1. Accounts

You must provide accurate company, contact and billing information and keep it up to date. The person creating the account confirms they are authorised to bind the Customer. You are responsible for all activity under your account, for the users you invite (team members, partner agencies) and for keeping passwords confidential.

2. Free trial

New accounts may benefit from a free trial of 14 days. No payment is taken during the trial. To keep using the Service after the trial, a valid payment method must be provided. If no subscription is started, access may be suspended at the end of the trial.

3. Subscription, prices and payment

• The Service is billed per developer account, monthly or yearly, in advance, at the price shown at sign-up or agreed in writing.
• Subscriptions renew automatically for the same period unless cancelled before the renewal date.
• Payments are processed by our payment provider. Prices exclude taxes; applicable VAT or sales tax is added where required.
• We may change prices with at least 30 days' notice; the new price applies from the next renewal.
• Late or failed payment may lead to suspension of access after notice.

4. Promo codes

Promo codes are subject to their stated conditions (amount, eligible plan, duration, expiry date and number of uses). They have no cash value, cannot be combined unless stated, and may be withdrawn at any time before being applied. When a time-limited discount ends, the regular price applies.

5. Cancellation and refunds

You may cancel at any time from your account or by writing to us. Cancellation takes effect at the end of the current billing period; amounts already paid are not refunded, except where required by law. We may terminate an account for material breach of these Terms after notice, or immediately in case of unlawful use.

6. Your data

You keep full ownership of all data you enter or upload (clients, units, documents, invoices, etc.). You grant us only the rights needed to host and operate the Service for you. Each developer's data is kept separate from other customers. You are responsible for having a lawful basis to process the personal data of your clients, agents and partners, including identity documents collected for KYC. After cancellation, you can request an export of your data within 30 days; it is then deleted from our active systems.

7. Acceptable use

You agree not to use the Service for unlawful purposes, to send unsolicited bulk email, to upload malicious content, to attempt to access other customers' data, or to resell the Service without our written consent.

8. Availability and support

We aim to keep the Service available at all times but do not guarantee uninterrupted access. Maintenance may occasionally be required. Support is provided by email during business hours.

9. Documents generated by the Service

Offers, statements of account, receipts and commission invoices are generated from the data you enter. You remain responsible for checking their accuracy and legal compliance before sending them. Amounts shown in currencies other than the unit's base currency are indicative only.

10. Liability

The Service is provided "as is". To the extent permitted by law, we are not liable for indirect losses, loss of profit, loss of data or business interruption. Our total liability is limited to the amounts paid by you for the Service in the 12 months before the event giving rise to the claim.

11. Changes to these Terms

We may update these Terms. Material changes will be notified by email or in the Service at least 30 days before they take effect. Continued use after that date means acceptance.

12. Governing law

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Disputes shall be submitted to the competent courts of Dubai.
